AFRANCA SERVICES

These general conditions of sale are concluded between the company AFRANCA SERVICES, registered with the GRENOBLE RCS under number 908 707 342 (“AFRANCA SERVICES”) and any legal entity (hereinafter the “Client”) wishing to reserve an event organization service on his behalf.

The fact of reserving a Service with AFRANCA SERVICES implies full and complete membership and without reservation from the Client and Participants to the general conditions of sale of AFRANCA SERVICES (hereinafter the “Conditions of Sale” or “CGV”). Any contrary condition opposed by the Client or the Participant, in particular any contrary clause resulting from its own general conditions, is unenforceable against AFRANCA SERVICES, unless express, written and prior acceptance of the latter.

AFRANCA SERVICES reserves the right to modify the General Terms and Conditions at any time. Conditions of sale applicable to the reservation of a Service are those in force on the date of firm confirmation of the Service (hereinafter the “Confirmation”), materialized by receipt by AFRANCA SERVICES of the quote signed or written confirmation of the reservation.

1. RESERVATION

WARNING

To reserve and/or pay for a Service, the Customer must be an adult or emancipated minor, be capable legally to contract and respect the General Conditions of Sale.

The Customer is responsible for the reservations he makes both in his name and on his behalf and on behalf of Passengers when acting on their behalf. The Customer guarantees the veracity and accuracy of the information it provides.

RESERVATION REQUEST, ISSUING OF A QUOTE & RESERVATION CONFIRMATION - All handled byt the Snowcompare.com website in this instance & subject to their booking T&Cs.

2. PRICES

Pricing rules may vary depending on certain circumstances such as public holidays, busy periods, pick-up area and/or use of the Service, time of day etc.

Prices are quoted inclusive of tax and include:

➢ The driver service;

➢ Fuel;

➢ Motorway toll and parking fees;

➢ Professional civil liability insurance for “persons transported” to pecuniary ;

➢ VAT at the rate set by the regulations in force.

Unless expressly stated otherwise in the quote, prices do not include entry fees into sites, public or private properties, driver meals.

Additional fees may be required in the event of a specific request from the Customer such as baby seat, special refreshments. The amounts invoiced will be specified in the quote or the Reservation confirmation.

AFRANCA SERVICES reserves the right to modify the price list at any time without notice. These modifications will be communicated to the Client and will apply to all Services reserved after the updating of the price list.

EXCEEDING TIME OR MILEAGE (EXCLUDING TRANSFER SERVICES)

For any Service, AFRANCA SERVICES may decide on a minimum billing specified in the estimate. At any time during a service, the customer may decide to change the destination or interrupt it. In this case, the customer will be billed for the time and distance traveled and completed and at least the package provided at the time of booking.

Any overrun on the scheduled return time will be charged in addition on the basis of thecurrent rate indicated in the price list. Any excess mileage will also be billed according to the current rates indicated in the price list.

3. CONDITIONS OF EXECUTION OF THE SERVICE

PASSENGER CARE

The Passenger(s) are required to comply with the handling rules indicated by AFRANCA SERVICES and the driver assigned to the execution of the Service. The responsibility of AFRANCA SERVICES cannot be engaged in the event of non-compliance by the passenger(s) with the procedure for support having the effect of preventing the provision of the Service.

The Highway Code requires Passengers to fasten their seat belts in the front and back of the vehicle. Failure to comply with this rule releases AFRANCA SERVICES from liability in the event of accident.

AFRANCA SERVICES may choose to subcontract, transfer or assign all or part of the Service to a third party of its choice, without first notifying the Customer.

ALCOHOL AND TOBACCO ON BOARD

AFRANCA SERVICES maintains a strict no-smoking policy in all of its vehicles. The failure to comply with this provision will result in cleaning and remediation charges being charged of a fixed amount equal to €250 including tax.

Unless expressly authorized in writing by AFRANCA SERVICES, the consumption of alcohol is not permitted in vehicles. The Driver and AFRANCA SERVICES have the right to refuse to carry any Passenger who is believed to be under the influence of alcohol or drugs and whose behavior constitutes a threat to the driver, the car or any other passenger.

ITINERARY AND ROUTE

The transport route is at the discretion of the driver who takes the shortest route.

In the event of events beyond our control (congestion, closed roads, traffic exceptional, accidents, etc.) the driver may modify the initial journey without notice and without price increase for the customer in order to travel in the best conditions. If the driver cannot modify the initial route and only through the fault of these events independent of our will, the transfer had to be delayed, AFRANCA SERVICES cannot be held responsible for the possible financial consequences, and the customer will not be able to claim any form of compensation.

During the journey, only one courtesy stop will be possible and free if it is less than 10 mins. For all additional stops, the customer must inform AFRANCA SERVICES during the reservation or if the request occurs during the service, in these cases, stopping will be possible in depending on the vehicle schedule and invoiced to the customer.

BAGGAGE POLICY

The total weight of baggage is limited to what is compatible with the vehicle used, within the limit of accessible space. The driver and/or AFRANCA SERVICES may refuse luggage or objects exceeding this carryover. In particular, for security reasons, will refuse to load any baggage bulky in the passenger compartment. Will not be held responsible for any loss of baggage due to or after the service. The passenger's personal effects are the responsibility of the passenger and AFRANCA SERVICES will not be held responsible for any loss or damage to these effects.

VEHICLE CAPACITY – NUMBER OF PASSENGERS CARRIED

The maximum number of passengers in the car (including the Driver) must not exceed the maximum number of passengers mentioned in the technical specifications of the car. The Driver and/or AFRANCA SERVICES reserve the right to refuse a passenger exceeding these boundaries.

PETS

Small dogs and other small pets weighing no more than 6 kg, suitably enclosed in a container not exceeding 45cmx30cmx25cm are accepted at on board vehicles, up to a maximum of two. Subject to this reservation, no other domestic animal is accepted on board vehicles.

4. MODIFICATION AND CANCELLATION OF RESERVATIONS

Modification or cancellation requests are made according to one of the processes authorized for the reservation of the Services.

EDIT

Any modification of the Reservation must be made to AFRANCA SERVICES at least two (2) days prior to the Service. After these deadlines, AFRANCA SERVICES will invoice all or part of the Service reserved according to the following terms. In the event of modification of the Reservation, the Service actually provided is invoiced.

CANCELATION

AFRANCA SERVICES will apply the following cancellation fees:

▪ From reservation to 8 days of transport: 50% of the total reserved;

▪ With a minimum of €100 per trip per vehicle;

▪ Reimbursement of the difference between the deposit paid and the cancellation fees.

▪ From 7 to 0 days of transport and no-show: 100% of the total reserved.

5. DELAY

AFRANCA SERVICES is not responsible for delays caused in the event of force majeure and/or for reasons beyond its control (strikes, traffic conditions, disasters natural, train/plane delay).

DRIVER DELAY

The driver is deemed late if he arrives after the meeting time fixed at the time of reservation of the Service. In the event of a delay, AFRANCA SERVICES contacts the Client to notify them of this delay and, If support is not possible, offer an alternative solution. In the absence of alternative solution, the Customer may be compensated, compensated or reimbursed on the understanding that the amount reimbursed, as well as the liability of AFRANCA SERVICES, will be limited to the amount expected from the reserved Service or, when the latter is not determined, to a maximum of 150 Euros.

6. COMMITMENT AND RESPONSIBILITY

AFRANCA SERVICES acts as a passenger transport company with drivers and as such title declares to comply with the professional regulations in force. It assumes the security obligation that any professional carrier is bound towards people transported as well as the responsibilities linked to the control of the transport vehicle of people, whether owner or tenant.

AFRANCA SERVICES declares that it holds an insurance contract covering its civil liability professional for the exercise of the activity of transporting people and in particular all financial consequences of bodily, material and immaterial damage which it would have to respond in the context of carrying out the Services, particularly following a road accident traffic from the time the passenger gets into the Vehicle until they get out, with the exception damage caused by the fault of the passenger.

AFRANCA SERVICES assigns drivers with capacity to carry out the Services regulations, carefully selected, in line with the needs and requests of the Client.

CUSTOMER DELAY

The driver is required to wait for the customer 30 minutes after the meeting time. After this time, the customer not present at the pick-up point is deemed absent (“no-show”). In this hypothesis, the customer will be billed for the amount of the reserved journey. In case of delay beyond 30 minutes and if the schedule of the vehicle and driver allows it, we will wait until your arrival at a rate of €100 including tax for the hour of waiting (from the end of the 30 minutes of waiting included), calculated in 15-minute increments, i.e. €25 including tax. Any period started is due.

7. DETERIORATION

The Client will be responsible for any damage caused by him or by people with him in the car (with the exception of the Driver) or the Passenger(s) during the Service, inside the Car, and will be charged accordingly for any repairs or troubleshooting necessary to restore the Car in good working condition and/or cleanliness and/or presentation.

8. REGULATION, PAYMENT AND SUPPORTING DOCUMENTS

PAYMENT TERMS - all handled by Snowcompare.com according to their own T&Cs.

CLAIM

In the event of a dispute over the amount of the invoice or the terms and conditions for carrying out the Service, the Customer can send a complaint by registered letter with acknowledgment of receipt (LRAR) from AFRANCA SERVICES at the following address: AFRANCA SERVICES – 16 Rue rene descartes, 38320 Eybens

Any complaint is only admissible within 8 days following the execution of the Service concerned and in writing, failing which it cannot be taken into account.

9. FORCE MAJEURE

AFRANCA SERVICES cannot be held responsible if non-execution or delay in the execution of one of its obligations described in these general conditions of sale arises from a case of force majeure. As such, force majeure means any event external, unpredictable and irresistible within the meaning of article 1148 of the Civil Code.

10. RIGHT TO THE IMAGE

Unless contraindicated, the Client authorizes AFRANCA SERVICES to use its name and logo for purposes promotional messages on its networks and commercial media.

11.CONFIDENTIALITY POLICY

Identity and contact details of the data controller

The personal data collected are processed by the services of the company AFRANCA SERVICES, Simplified joint stock company with share capital of €3,000, registered with the RCS DE GRENOBLE under number 908 707, whose head office is 16 rue rene descartes 38320 Eybens.

Purpose of processing

Data collected via our various means (websites, contact, offer, order, etc.) are collected and processed by AFRANCA SERVICES in order to be able to respond and process your request.

AFRANCA SERVICES will do what is necessary to respond satisfactorily to requests. If, for whatever reason, the Customer considers that the response provided is not satisfactory, a complaint to the CNIL may be made.

12.LIMITATION OF LIABILITY

Failure to comply with safety rules by participants during the event disclaims all responsibilities AFRANCA SERVICES.

The customer is solely responsible for any material damage and/or bodily harm caused by participants.

It is also responsible for losses, breakage, damage or disappearance of equipment placed in its possession disposal, as well as the costs of restoring the premises. In the event that participants are in manifest state of intoxication, AFRANCA SERVICES reserves the right to stop all services, without that no refund can be requested.

13.APPLICABLE LAW

The General Conditions and any related contract are exclusively executed, governed and construed in accordance with French law.

In the event of a dispute, the Customer will contact AFRANCA SERVICES to obtain amicable treatment of its claim. Any dispute that cannot be resolved amicably will be brought before the Commercial Court from Grenoble.

If one or more stipulations of these General Conditions of Sale are null and void or inapplicability, the other stipulations will retain all their force and scope.

14.VERY IMPORTANT

The transport of people for a fee is a regulated activity. Only authorized vehicles (Transport Car with Driver; Occasional Transport) can perform this service, within the legal and regulatory provisions provided for. We allow ourselves to put our customers in guard against certain companies or individuals not respecting these provisions and being unable to offer no guarantee.

The company AFRANCA SERVICES meets the requirements of establishment and good repute professional, financial capacity and professional capacity required by articles R.3113-18 to R.3113-42, R.3511-3, R.3511-4, R.3521-3; R.3521-4 of the transport code, and thus has authorization to exercise the profession of public road carrier by means exclusively of vehicles not exceeding nine seats, including the driver. License n°2023/84/0002731 issued by the Ministry of Transport on 10/28/2020.

The company AFRANCA SERVICES is also registered in the register of transport vehicles with driver under number EVTC038220007 valid until January 24, 2027. Certificate issued by the Ministry of Ecological and Inclusive Transition.

The company AFRANCA SERVICES has signed a contract covering the financial consequences of its professional civil liability, established in accordance with articles R.211-35 to R.211-40 of the code tourism as amended by decree no. 2015-1111 of September 2, 2015.
